By checking the box, you consent Contemporary Tiny Homes LLC to send SMS messages to you with appointment confirmation and reminders (the "SMS Appointment Confirmation & Reminders Program"). Please read the following terms carefully prior to giving your consent.

1) Consent: By checking the box, you acknowledge that you have read and understood the terms of this agreement. You also confirm that you are the authorized owner of the provided contact information and that you are at least 18 years old or have obtained parental consent.

2) Program Description: By subscribing to the SMS Appointment Confirmation & Reminders Program, you consent Contemporary Tiny Homes LLC to send SMS messages to you with appointment confirmation and reminders.

3) Opting Out: You have the right to cancel your subscription to the SMS Appointment Confirmation & Reminders Program at any time by replying "STOP", upon which you will no longer receive SMS messages from us. If you wish to rejoin, reply "START" and we will resume sending SMS messages to you.

4) Frequency: Contemporary Tiny Homes LLC will send messages to you predicated by the cadency of your appointments with us. Contemporary Tiny Homes LLC will make reasonable efforts to ensure that the frequency of messages is not excessive.

5) Data Charges: Standard data and message rates may apply for message that you receive from or send to Contemporary Tiny Homes LLC. You are solely responsible for any charges incurred from your telephone service provider. If you have any questions regarding your data plan or text plan, kindly contact your telephone service provider. Telephone service providers are not liable for delayed or undelivered messages.

6) Security: Contemporary Tiny Homes LLC will take reasonable measures to protect your personal information and ensure the security of the messages sent to or received from you. However, no method of transmission over the Internet or electronic storage is completely secure, and Contemporary Tiny Homes LLC cannot guarantee absolute security.

Welcome to Contemporary Tiny Homes LLC’s referral program! These Terms and Conditions (the "Terms & Conditions") govern your participation in Contemporary Tiny Homes LLC’s Referral Program (the "Referral Program"). By participating in the Referral Program, you agree to these Terms & Conditions. Please read them carefully.

1) Program Overview: The Referral Program allows an eligible participant (the "Referrer") to refer a friend, relative, colleague or acquaintance (the "Lead") to Contemporary Tiny Homes LLC. The Referrer may earn a “Referral Reward” of $3,000 (three thousand dollars) for each referral that yields a bona fide sale of an Accessory Dwelling Unit (“ADU”) by Contemporary Tiny Homes LLC to the Lead. The Referrer and the Lead must meet the Eligibility Requirements below. The Limitations and Restrictions below apply.

2) Eligibility Requirements:

Both the Referrer and the Lead must be at least 21 years old.

The Referrer must (i) reside in the United States, (ii) possess a valid Tax Identification Number (“TIN”), which may be a Social Security Number (“SSN”), Individual Taxpayer Identification Number (“ITIN”), Adoption Taxpayer Identification Number (“ATIN”), or Employer Identification Number (“EIN”), and (iv) be in good standing with no violations of any of Contemporary Tiny Homes LLC’s policies. The Referrer must fill out a Request for Taxpayer Identification Number and Certification (“Form W-9”) prior to receiving any Referral Reward.

The Lead must be a new prospective customer who had not previously engaged with Contemporary Tiny Homes LLC prior to the referral by the Referrer. The Referrer will not be compensated for the provision of contacts previously known to Contemporary Tiny Homes LLC prior to the referral or provided by someone other than the Referrer.

Within 60 calendar days from the referral date, the Lead must purchase an ADU from Contemporary Tiny Homes LLC for at least $150,000 (one hundred fifty thousand dollars) by executing Contemporary Tiny Homes LLC’s construction contract (the “ADU Construction Contract”) and paying the amount that is due and payable upon the execution of said contract.

The Lead must own a property in a town that allows ADUs, located either in Connecticut or in Westchester County, New York, where Contemporary Tiny Homes LLC is able to obtain all necessary permits, from the authority having jurisdiction, to build an ADU.

3) Referral Process:

Submit Contact Information. The Referrer will need to submit their personal contact information and the Lead’s contact information utilizing the referral form on Contemporary Tiny Homes LLC website: https://ctiny.homes/referral-program.

Referral Communication. The Referrer will be contacted promptly after the Lead’s purchase of an ADU from Contemporary Tiny Homes LLC.

Delivery of the Referral Reward. The Referral Reward will be credited to the Referrer’s account via ACH or delivered via check within 10 (ten) business after the Lead pays the amount that is due and payable upon the execution of an ADU Construction Contract with Contemporary Tiny Homes LLC, as determined by said contract.

Tax Liability. The Referrer is responsible for any federal, state and local tax liabilities associated with the Referral Reward.

4) Limitations and Restrictions:

Non-Transferable. Referral Rewards are non-transferable and non-exchangeable. The Referrer will not voluntarily, or by operation of law, assign or otherwise transfer their rights and obligations under these Terms & Conditions without the prior written consent of Contemporary Tiny Homes LLC.

Self-Referral. The Referrer cannot refer themselves.

Bona Fide Referral. The Referrer must only refer real individuals who meet the requirements of these Terms & Conditions and are likely to be interested in acquiring an ADU from Contemporary Tiny Homes LLC.

Fraud Prevention. Any fraudulent activity or misuse of the Referral Program, as determined by Contemporary Tiny Homes LLC in its sole discretion, will result in disqualification from the Referral Program and forfeiture of any Referral Reward.

Program Changes. Contemporary Tiny Homes LLC reserves the right to modify or terminate its Referral Program at any time without prior notice. Changes will not affect any Referral Rewards earned prior to the modification or termination.

Exclusions. Employees, affiliates, and partners of Contemporary Tiny Homes LLC, along with their immediate family members, are not eligible to participate in the Referral Program.

Legal Compliance. The Referrer shall comply with all applicable laws. The Referrer warrants to Contemporary Tiny Homes LLC that the Referrer has obtained permission from the Lead to share the Lead’s contact information with Contemporary Tiny Homes LLC.

No Restrictive Covenants. The Referrer warrants to Contemporary Tiny Homes LLC that there are no restrictive covenants that restrict the Referrer from referring the Lead to Contemporary Tiny Homes LLC in connection with (i) referring competitor’s customers or other third parties and (ii) using confidential information within their knowledge.

Expenses. The Referrer will not be reimbursed for any expenses incurred in connection with referring the Lead to Contemporary Tiny Homes LLC.

No Exclusivity. The Referrer does not have any exclusive rights to introduce Leads to Contemporary Tiny Homes LLC.

No Cancellation. The Referral Reward cannot be awarded if the Lead cancels the ADU Construction Contract within three (03) - business days from execution.

Stacking Restriction. The Referral Reward cannot be awarded in addition to any other promotion or discount. The Referral Reward is limited to one per ADU sold.

5) Miscellaneous:

Dispute Resolution. Any dispute arising from these Terms & Conditions that the parties are unable to resolve by themselves shall be resolved through mediation. If the dispute cannot be resolved through mediation, then the dispute will be resolved through arbitration in the State of Connecticut conducted in accordance with the rules of the American Arbitration Association. The written decision of the arbitrator(s), as applicable, shall be final and binding. Judgment on a monetary award or enforcement of injunctive or specific performance relief granted by the arbitrator(s) may be entered in any court having jurisdiction over the matter.

Authority to Contract. The Referrer acknowledges and agrees that the Referrer does not have authority to enter into any binding contracts or commitments for or on behalf of Contemporary Tiny Homes LLC without first obtaining the prior written consent of Contemporary Tiny Homes LLC.

Governing Law. These Terms & Conditions and the rights of the parties hereto shall be governed exclusively by the laws of the State of Connecticut, without regarding its conflicts of law provisions.

Entire Agreement. These Terms & Conditions constitutes the entire agreement between the parties hereto with respect to the subject matter hereof, and supersedes all prior negotiations, understandings and agreements of the parties.

Notices. All notices, requests, demands or other communications required or permitted by these Terms & Conditions from the Referrer to Contemporary Tiny Homes LLC shall be given in writing and delivered to Contemporary Tiny Homes LLC at the following address: 40 Richards Avenue, Suite 740, Norwalk, CT 06854.

Waiver. Contemporary Tiny Homes LLC shall not be deemed to have waived any provision of these Terms & Conditions unless such waiver is made expressly and in writing. Waiver of a breach or violation of any provision of these Terms & Conditions shall not constitute a waiver of any subsequent or other breach or violation.

No Indirect Damages. To the extent permitted by applicable law, in no event shall Contemporary Tiny Homes LLC be liable for any indirect, punitive, or consequential damages, including but not limited to lost profits or business opportunities.

Limitation of Liability. If notwithstanding the other provisions of these Terms & Conditions, we are determined to have any liability to the Referrer or any third party, the parties agree that Contemporary Tiny Homes LLC’s aggregate liability will be limited to the Referral Reward that the Referrer has actually earned for the related customer transaction giving rise to a claim.

Severability. If any provision of these Terms & Conditions is held to be invalid, illegal or unenforceable in whole or in part, the remaining provisions shall not be affected and shall continue to be valid, legal and enforceable as though the invalid, illegal or unenforceable parts had not been included in these Terms & Conditions.

Headings. The section headings herein are for reference purposes only and shall not otherwise affect the meaning, construction or interpretation of any provision in these Terms & Conditions.

Independent Contractor. In providing referrals under these Terms & Conditions, it is expressly agreed that the Referrer is acting as an independent contractor and not as an employee. The Referrer and Contemporary Tiny Homes LLC acknowledge that these Terms & Conditions do not create a partnership or joint venture between them. Contemporary Tiny Homes LLC is not required to pay, or make any contributions to, any social security, local, state or federal tax, unemployment compensation, workers' compensation, insurance premium, profit-sharing, pension or any other employee benefit for the Referrer. The Referrer is responsible for paying, and complying with reporting requirements for, all local, state and federal taxes related to payments made to the Referrer under these Terms & Conditions. Except as otherwise provided in these Terms & Conditions, the Referrer will have full control over working time, methods, and decision-making in relation to provision of referrals in accordance with these Terms & Conditions. The Referrer will work autonomously and not at the direction of Contemporary Tiny Homes LLC. Except as otherwise provided in these Terms & Conditions, the Referrer will provide, at the Referrer’s own expense, any and all equipment, software, materials and any other supplies necessary to provide referrals in accordance with these Terms & Conditions..

Read and Understand. The Referrer acknowledges that they have read and understood these Terms & Conditions and have been given the opportunity to seek independent legal advice concerning the terms contained in these Terms & Conditions.
